These Terms of Use (”Terms”) govern your use of the websites and mobile applications provided by Decennium Platforms Limited registered in Hong Kong (or referred to as “Decennium”, “Freeride”, “we” or “us”) through our freeride.app website or applications published on Apple App Store and Google Play Store (each referred to as an “Application”) (collectively the “Platform”). Any new services, features, or campaigns added to the Platform are also subject to these Terms.
Please read these Terms carefully before accessing and using our services. Your access and use of the Platform constitutes your agreement to be bound by these Terms, which declares that you have agreed and accepted the Terms and consent to the processing of your personal data in accordance with the terms set out in the Privacy Policy. If you do not agree or fall within the Terms, please do not access or use the Platform.
We may amend the Terms related to the Platform from time to time without announcement or notifications. Amendments will be effective upon publishing the updated Terms.
1. Information about Freeride
Freeride is a technology company founded by a young pet owner in Hong Kong. We provide convenient ride-matching services for users and drivers. Our role is merely to link users for a ride, without facilitating any direct or indirect financial transactions. Our aim is to foster friendships through random ride matches.
Using our platform, Freeride accepts your order to match you with a user equipped with a vehicle (”driver”) . This service takes you from one location to another. Once you place an order, Freeride charges you for our service through electronic payment methods. The driver uses our mobile application to communicate with you and provide a ride according to your order. Please note that according to Hong Kong law, users in Hong Kong are not allowed to pay the driver for the ride in cash.
2. Our Service
Freeride aims to foster friendships through providing a platform where users can be matched with drivers for shared rides. Our goal is to create a community of users who not only share rides, but also experiences and stories. This service is designed to be more than just a transportation option; it's a way to connect people.
You acknowledge that:
i) You are attempting to make new friends with special criteria, such as owning a private car or light goods van (”vehicle”), through our Platform;
ii) You are not paying for the ride service by the driver, but the matching fee to our Platform for arranging a driver with your special requirement. The matching fee is calculated by our Platform based on resources required to compute the result for your order;
iii) Photos, images, or video display anywhere and else where on our Platform are for illustration purposes and reference only, and shall not form or constitute an invitation, offer, contract, representation or warranty, espressly or impliedly;
iv) You constitute a relationship with our driver as friendship once you accepted our matching result and continued to use our service through the Platform;
v) You agree the payment processed on our Platform are solely earned by Decennium, your payment shall not constitute any part of the income of the driver.
vi) You acknowledge that any disputes, conflicts, incidents and safety issues that arise between you and the driver are to be resolved directly between you two and Freeride holds no responsibility.
3. Your Account
Freeride requires you to register an account before using the Platform.
During your registration process, you are required to provide your personal information including a valid mobile phone number, a valid email address, and a unique password. You must keep all the information secret preventing others from accessing your account. If another person uses these method to access your account, you will be responsible to pay for any orders placed, and we are not responsible for any other losses you suffer.
To place a matching order, you are required to add a credit card to continue the payment for our service. You need to provide credit card details to continue the payment. All of your credit card informations are securely processed by a reputable global payment provider.
You may delete your account at any time by requesting to do so in the account section of our mobile application. We may also suspend, ban, or terminate your account if we believe that it has been involved in illegal activities, has provided false information, has attempted fraud, or has been used by an unauthorized person.
4. Service Availability
Freeride functions as a free and accessible platform for facilitating the formation of new friendships through ride sharing. We will make every effort to ensure that you can connect to the Platform and place matching orders. Our services will typically remain available regardless of weather conditions. However, it is your responsibility to determine whether or not to utilise the service on your judgement to the actual situation and availability.
5. Orders and Restrictions
Before you place an order and process payment, you will be notified about the matching service amount request by our Platform depending on the resources required to match a driver. The amount of the matching service is not fixed, and may fluctuate. The amount displayed before you placed and order are estimated charge and not assumed as the final charge amount. Any constant fee such as toll, your tips to the platform will be applied to your final charge.
We will attempt to match a driver on our platform and introduce to you after you have successfully placed an order. However, the matching result are largely affected by multiple factors, such as active users on the Platform, distance, and traffic conditions. If the system is unable to match a driver for you, we will cancel the authorisation of charge requested to your credit card. You will not be charged for our matching service.
Once a driver accepted the order, i.e. attempted to establish a friendship with you, the driver will utilise his/ her vehicle as requested by you to your designated pickup point. Upon meet up, the driver will confirm the order with you by asking you to provide your last four digits of your phone number.
The driver has no responsibility to continue or establish friendship with you after you arrived the destination.
You are not allow to bring any illegal items or attempt any illegal activities during the ride. Any form of harassment or misconduct towards the driver will not be tolerated and may result in immediate termination of the service and suspension of your account.
You are responsible for maintaining a clean environment in the vehicle provided by the driver. In the event of damage or the need for cleaning resulting from misuse or careless acts on your part, you shall be liable for the repair costs or necessary cleaning expenses. The driver may submit a fee request through our Platform, and we will act as an intermediary to notify you of the request. If the request is ignored or remains unresolved, Freeride reserves the right to facilitate payment for the reasonable cost of such damage on behalf of the driver.
6. Cancelling an Order
You may cancel your matching order 60 minutes before your designated start time without any penalty.
You will still be charged for the matching service fee if you cancel the order within 60 minutes from the start time of the order. The amount will be displayed on our Platform.
7. Discounts and Promotions
From time to time, Freeride may run marketing and promotional campaigns which offer discounts and promotional offers to be used on the Platform (collectively “vouchers”). Vouchers are subject to validity periods, redemption periods, use restrictions, limits and/or other availability. Freeride may withdraw, amend and/or alter any applicable terms and conditions of the vouchers at anytime without prior notices. Freeride further reserves the right to void, discontinue or reject the use of any voucher without prior notice to you.
8. Intellectual Property Rights
We are the owner of, or the licensee of, all intellectual property rights in our Platform, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use any content on our site in any way except for your own personal, non-commercial use.
9. Our Liability
While we have taken every precaution in the preparation of our Site and Service, we cannot guarantee the absence of errors or omissions in the content or the absence of technical issues that you may encounter while using our Site or Service. We will make reasonable efforts to correct any inaccuracies or issues if we are made aware of them. However, to the fullest extent permitted by law, we disclaim all liability (whether in contract, negligence, or otherwise) for any loss or damage incurred by you or any third party in connection with our Site, Service, or any linked websites and posted materials. This disclaimer does not affect our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, misrepresentation of a fundamental matter, or any other liability that cannot be excluded or limited under applicable law.
10. Jurisdiction
Any claim arising from or related to the use of our Services shall be exclusively subject to the jurisdiction of the courts in Hong Kong. These terms of use, and any dispute or claim arising from or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and interpreted in accordance with the laws of Hong Kong.
